An exotic dancer is suing a Las Vegas strip club, alleging staff failed to protect her after a patron sexually assaulted her and repeatedly exposed himself.

An attorney for plaintiff Mayisel Martinez filed the lawsuit Monday against The Kitchen, LLC, which operates Las Vegas Strip Club, accusing the business of negligence, improper hiring and supervision, and intentional infliction of emotional distress, the Las Vegas Review-Journal reports.

The complaint also names Jesse Tamez, a Texas man arrested in connection with the 2025 incident who pleaded no contest to a lewd conduct charge, as a defendant. Martinez accuses him of assault, battery and intentional infliction of emotional distress.

The lawsuit reportedly states that Martinez was working at the club, located just off the famous Vegas Strip at 3500 W Naples Drive, on March 23, 2025, when Tamez booked a 30-minute private dance in the champagne room.

During the performance, Tamez allegedly exposed himself and began preforming a sex act. Martinez reprimanded him, and he apologized before she agreed to continue the dance, according to the lawsuit. However, he then allegedly grabbed and kissed her aggressively before exposing himself again.

Martinez reported the behavior to security, but Tamez was not removed from the room, the complaint reportedly states. Instead, a manager allegedly told her to complete the prepaid dance.

“After being placed on notice of the patron’s dangerous conduct, the Club failed to remove him, directed or allowed Ms. Martinez to resume the dance, and made no operational changes to protect her thereafter,” the lawsuit states, per the Review Journal.

Tamez assured Martinez that he would behave, but after the performance resumed, he allegedly undressed and began touching himself again, according to the lawsuit.

The complaint argues that the club failed to implement or enforce adequate safeguards for dancers, including measures to address reports of sexual misconduct in private rooms.

“The Club breached its duty by failing to adequately train security staff to recognize and respond to reports of sexual assault, failing to implement or enforce safety protocols in the champagne room, including panic buttons, monitoring, or mandatory removal of patrons reported for sexual misconduct, and failing to take corrective action after the incident,” the lawsuit states.

Martinez’s attorneys also accused the club of inadequately training and supervising its security staff, pointing to their handling of her complaint as evidence of the alleged failures.

“The Club’s security personnel were unfit for, or inadequately trained and supervised in, their responsibilities for dancer safety, as demonstrated by their response to Ms. Martinez’s report: merely warning Mr. Tamez, allowing him to remain alone with Ms. Martinez in the champagne room, and returning her to the dance,” the lawsuit says.

Tamez was arrested after the incident and initially charged with gross lewdness and indecent exposure, according to Las Vegas Justice Court records reviewed by The Independent. He later pleaded no contest to engaging in lewd conduct in a public place and received a 120-day suspended jail sentence, court records show.

The penalties also included a one-year order to stay out of trouble, a no-contact order with Martinez, a ban from Las Vegas Strip Club and a requirement to undergo impulse control counseling.

Martinez is seeking damages exceeding $15,000 for each of the lawsuit’s six claims.

The Independent has contacted an attorney potentially representing Tamez. A representative for Las Vegas Strip Club could not be reached.
